The purpose of this privacy policy (this “Privacy Policy”) is to inform users of our Site of the following:

1. The personal data we will collect;
2. Use of collected data;
3. Who has access to the data collected;
4. The rights of Site users; and
5. The Site's cookie policy.

This Privacy Policy applies in addition to the Terms and Conditions of our Site.

By using our Site, users agree that they consent to:

1. The conditions set out in this Privacy Policy; and
2. The collection, use, and retention of the data listed in this Privacy Policy.

For program participants under the age of majority in British Columbia (19 years), consent is provided by a parent or legal guardian as set out in our Guardian Enrollment Addendum.

We only collect data that helps us achieve the purpose set out in this Privacy Policy. We will not collect any additional data beyond the data listed below without notifying you first.

Data Collected Automatically

When you visit and use our Site, we may automatically collect and store the following information:

1. IP address;
2. Location;
3. Clicked links; and
4. Content viewed.

This data may be collected using website analytic tools like Google Analytics.

Data Collected in a Non-Automatic Way

We may also collect the following data when you perform certain functions on our Site or enroll in our programs:

1. First and last name;
2. Email address, phone number, and address;
3. Date of birth (to confirm age of majority);
4. Parent or guardian name, contact information, and relationship to the participant (for participants under 19);
5. Payment information;
6. Enrollment details, such as program and cohort selection;
7. Program work, assignments, progress records, feedback, and attendance created or recorded during training;
8. Proof of upcoming employment (only if you submit a Withdrawal Due to Employment request under our Terms and Conditions); and
9. Communications you send us, such as emails and feedback form submissions.

This data may be collected when you create an account, enroll in a program, make a payment, participate in training, or contact us.

Data collected on our Site will only be used for the purposes specified in this Privacy Policy or indicated on the relevant pages of our Site. We will not use your data beyond what we disclose in this Privacy Policy.

The data we collect automatically is used for website analytics.

The data we collect when users perform certain functions may be used for the following purposes:

1. For account creation;
2. To process payments, refunds, and invoices;
3. To schedule sessions, such as web conferences, portfolio reviews, and more;
4. To deliver our training programs, including feedback, progress tracking, and Production coordination;
5. To verify eligibility, including age of majority and guardian consent;
6. To assess Withdrawal Due to Employment requests;
7. To maintain program records and issue certificates; and
8. To send marketing communications about future cohorts, events, and offerings — only with your consent (see Marketing Communications below).

We do not sell your personal data.

Work created on Productions during our training programs is owned by Eat Your Peas Productions Inc., as set out in our Terms and Conditions. We may display this work in program showcases, on our Site, on social media, and in marketing materials.

Where we identify a student by name alongside their work (for example, in credits, testimonials, or social media features), we will obtain consent at enrollment. Students — or their guardian, for participants under 19 — may withdraw this consent at any time by contacting our privacy officer, and we will remove the identification from future materials within a reasonable time.

With your consent, we may send you emails about upcoming cohorts, events, and Eat Your Peas Productions offerings. Every marketing email includes an unsubscribe link, and you may opt out at any time. Transactional emails (such as receipts, invoices, and program notices) are sent regardless of marketing preferences, as they are required to deliver our Services. Our email practices comply with Canada’s Anti-Spam Legislation (CASL).

Employees

We may disclose user data to any members of our organization who reasonably need access to user data to achieve the purposes set out in this Privacy Policy.

Third Parties

We may share user data with the following third parties:

1. Chronly (our payment processor);
2. Google (website analytics);
3. Visa, Mastercard, and Apple Pay (payment networks);
4. Production partners — limited to information reasonably necessary for your participation in a Production, such as your name, role, and work submitted; and
5. Collection agencies — only where balances remain unresolved under our Terms and Conditions.

We may share the following user data with third parties:

1. Payment information;
2. Website use analytics; and
3. Program participation information, as described above.

Third parties will not be able to access user data beyond what is reasonably necessary to achieve the given purpose. Some service providers may store information outside of Canada; where they do, your information may be subject to the laws of those jurisdictions.

Other Disclosures

We will not sell or share your data with other third parties, except in the following cases:

1. If the law requires it;
2. If it is required for any legal proceeding;
3. To prove or protect our legal rights; and
4. To buyers or potential buyers of this company in the event that we seek to sell the company.

If you follow hyperlinks from our Site to another site, please note that we are not responsible for and have no control over their privacy policies and practices.

We retain personal data only as long as reasonably necessary for the purposes set out in this Privacy Policy:

1. Enrollment and financial records: up to seven (7) years, to meet tax and accounting requirements;
2. Program work and progress records: up to three (3) years after program completion;
3. Marketing consents and preferences: until consent is withdrawn; and
4. General inquiries: up to one (1) year.

When these periods expire, data is securely deleted or anonymized. You will be notified if your data is kept for longer than these periods.

All payment information is processed directly by our payment processors and is not stored on our systems.

While we take all reasonable precautions to ensure that user data is secure and that users are protected, there always remains the risk of harm. The Internet as a whole can be insecure at times and therefore we are unable to guarantee the security of user data beyond what is reasonably practical.

The minimum age to browse our Site is 13 years of age. We do not knowingly collect or use personal data from children under 13 years of age. If we learn that we have collected personal data from a child under 13, the personal data will be deleted as soon as possible. If a child under 13 has provided us with personal data, their parent or guardian may contact our privacy officer.

For our training programs, participants under the age of majority in British Columbia (19 years) may only enroll through a parent or legal guardian, who provides consent for the collection and use of the participant’s personal data as described in this Privacy Policy and our Guardian Enrollment Addendum. Administrative and financial communications for these participants are directed to the guardian. We collect only the participant information reasonably needed to deliver the program.

If you would like to know if we have collected your personal data, how we have used your personal data, if we have disclosed your personal data, and to whom we disclosed your personal data, or if you would like your data to be deleted or modified in any way, please contact our privacy officer via the “Contact” form on our website.

If you are not satisfied with our response, you may contact the Office of the Information and Privacy Commissioner for British Columbia or the Privacy Commissioner of Canada.

Do Not Track (“DNT”) is a privacy preference that you can set in certain web browsers. We do not track the users of our Site over time and across third-party websites and therefore do not respond to browser-initiated DNT signals. We are not responsible for and cannot guarantee how any third parties who interact with our Site and your data will respond to DNT signals.

A cookie is a small file, stored on a user’s hard drive by a website. Its purpose is to collect data related to the user’s browsing habits. You can choose to be notified each time a cookie is transmitted. You can also choose to disable cookies entirely in your internet browser, but this may decrease the quality of your experience.

We use the following types of cookies on our Site:

1. Functional cookies — used to remember the selections you make on our Site so that your selections are saved for your next visits;

This Privacy Policy may be amended from time to time in order to maintain compliance with the law and to reflect any changes to our data collection process. When we amend this Privacy Policy we will update the “Effective Date” at the top of this Privacy Policy. We recommend that our users periodically review our Privacy Policy to ensure that they are notified of any updates. If necessary, we may notify users by email of changes to this Privacy Policy.
